Do I have to go to court to sort out a family law matter?

Most matters never reach a final hearing. Parenting and property issues are commonly resolved by agreement, consent orders or mediation. Court is the path we take when the other side will not engage or a child is at risk, and it is the path we are fully prepared to take.

How much does a family lawyer cost in Sydney?

It depends on whether the matter settles by agreement or runs to a hearing. Lovemore Lawyers offers fixed-rate pricing on a number of family law services, and conditions apply. You will be told the likely cost of your matter at the first consultation, before you commit to anything.

How long do I have to sort out property after separation?

Married couples have twelve months from the date the divorce order takes effect to apply for a property settlement or spousal maintenance. De facto couples have two years from the date of separation. Outside those periods you need the court's permission, which is not always given.

Can I get divorced if my ex-partner does not agree?

Yes. Divorce in Australia is no fault. You need to show the marriage has broken down irretrievably and that you have been separated for at least twelve months. Your former partner cannot prevent it.

What is the difference between divorce and property settlement?

A divorce ends the marriage. It does nothing about your house, your superannuation, your debts or your children. Those are separate applications and separate decisions, and they are usually where the real work sits.
